Terms & Conditions for In Person & Online Work with Juliette

This agreement is entered into between Juliette Noske®, operating online, and yourself (“I”) for this and future visits.

CONFIDENTIALITY 

All correspondence in respect of our services, including session recordings provided by us, belong to us and must be kept confidential, both during and after the session. Such information can only be shared with our express and clear consent.

INTELLECTUAL PROPERTY
All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Juliette Noske®, or its content suppliers, and is protected by United Kingdom and international copyright laws. The compilation of all content on this site is the exclusive property of Juliette Noske®, with copyright authorship for this collection by Juliette Noske®, and protected by UK and international copyright laws.

CONSENT
I understand that:
• The images of myself captured in the video recordings and/or photographs of all online sessions will be the copyright of Juliette Noske®, and any other intellectual property which arises in the photographs/recordings will also belong to the Juliette Noske®;
• I hereby agree that all photographs and/or recordings of all online sessions belong to Juliette Noske®;
By signing up to any and all events, sessions or recordings, I am agreeing to these terms and conditions.

RELEASE
I agree that on behalf of myself (and all my personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Juliette Noske® (and its affiliates, related entities, employees, agents, representatives, successors and assigns) from any and all claims or causes of action (known or unknown) arising out of negligence from any of its staff, whether active or passive. This waiver and release of liability includes, without limitation, injuries which may occur as a result of a) any equipment or facilities which may malfunction or break, b) improper maintenance of any equipment, premises or facilities, c) negligent instruction or supervision, d) slipping or tripping and falling while on any portion of a premises or while traveling to or from any of the activities, including injuries resulting from staff or anyone else’s negligent inspection or maintenance of the facility or premises.

ACKNOWLEDGEMENTS
This release is not intended as an attempted release of claims of gross negligence or intentional acts. I acknowledge that I have carefully read this waiver and release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. I am aware and agree that by executing this waiver and release, I am giving up my right to bring a legal action or assert a claim against Juliette Noske®’s negligence. I have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

CANCELLATION POLICY
Tickets are non-refundable, but you can transfer it to another person for the same session with prior notice.  All one to one work requires a minimum of 48 hours cancellation notice.  Refunds are not available on sessions once completed. Refunds are not available on downloads from the store once purchased.

PUNCTUALITY
Sessions are charged from the time you have booked the slot and will finish when that time is complete.

RETREATS AND IN PERSON EVENTS, WORKSHOPS
This agreement is entered into between Juliette Noske®, operating at various locations in UK and worldwide, and yourself (“I”) for this and future visits.

DISCLAIMER OF WARRANTS & LIMITATIONS OF LIABILITY
You Expressly agree that your use of this site Juliette Noske® is at your sole risk. 
To the full extent permissible by applicable law, Juliette Noske® disclaims all warranties, expressed or implied, Including, but not limited to, Implied warranties of merchantability and fitness for a particular purpose. Juliette Noske® does not warrant that this site, its servers or email sent from Juliette Noske® are free of viruses or other harmful components. Juliette Noske® will not be liable for any damages of any kind arising from the use of this site including but not limited to direct, indirect, incidental, punitive and consequential damages.

APPLICABLE BY LAW
By visiting Juliette Noske® and www.juliettenoske.com, you agree that the laws of the UK, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Juliette Noske® or its associates.
